Freedom of Information Act Request Letter

Attorney General Brad Shimel:

This is a request for the documents including copies of emails, phone records, or other information regarding -  who supplied the information addressing the comments made in your recent press release describing the event of the tragic shooting of a 14-year-old boy in Odanah, WI.  Specifically this request is to determine who supplied the information this boy had been despondent over the few days leading up to the incident. Your office released this information. 

I understand that if I seek a copy of this record, there may be a copying fee. Please inform me of that cost prior to making the copy or copies.  I can be reached at 218.241.8822.

As you know, according to the statute, this request should be acted upon as soon as possible, but in no event later than the third business day following receipt of this letter.  If access to the records I requested is going to take longer, please contact me so we can work out a reasonable date.

If you choose to deny the request, then you are required to respond in writing and state the statutory exception authorizing the withholding of all or part of the public record and the name and title or position of the person responsible for the denial.

In addition, I am still waiting for a response or acknowledgement to my email of 11/13/17.

Frank: So long as there is a criminal investigation going on the courts have not compelled disclosure of police records. If you google "WI open records law" there is a guide that explains when records are required to be released and when the exceptions apply. As much as I may wish I had the power to demand immediate disclosure, I do not.

Thanks for your response - Seems to me the AG is conducing a pretty lousy investigation in that at least he should defend his Immediate Press Release. I do understand the law.
